The old Eugenic Protection Law, which determined the superiority and inferiority of human "qualities" and forcibly deprived those with inferior traits of their reproductive functions. In July 2024, the Supreme Court Grand Bench ruled that this law was "unconstitutional at the time of legislation." In 1948, when the law was enacted, Japan was under occupation by the Allied Forces. As is well known, the GHQ even drafted a new constitution that proclaimed the inviolability and permanent guarantee of basic human rights. How was this law able to be established in such a situation?
